Bradford Waste Management DPD

7. Examination (August 2016)

The Council submitted the Waste Management DPD to the Planning Inspectorate on Monday, 16 May 2016.

This page should be viewed alongside the submission webpage from which the original submission library may be accessed. The submission library also contains a full set of representations submitted at the Publication stage.

Further library items will be added to this Examination page as the Examination progresses and representors and other interested parties are encouraged to view it on a regular basis for new items and latest developments.

The Inspector

The Secretary of State has appointed Mr Stephen Pratt BA (Hons) MRTPI to undertake the examination into the Waste Management DPD.

The Programme Officer

The Council has appointed Mrs Jayne Knight as the Programme Officer for the examination who will deal with all administrative, procedural and programming matters.

The Programme Officer is not a Council Officer and has not been involved in the preparation of the Waste Management DPD. The Programme Officer works solely to the direction of the Inspector.

The hearings

The Inspector may consider holding a hearing session as part of the Examination process if he considers it necessary. Further details will be provided in due course by the Programme Officer to Publication Stage representors of the process of the Examination going forward and will be displayed on this webpage.

Bradford Waste Management DPD Inspector's Report

The adoption of the City of Bradford Metropolitan Council Waste Management Development Plan is to be considered at a meeting of Full Council on 17 October where a Formal Adoption Statement will be presented.

Mr S J Pratt, the Inspector appointed by the Planning Inspectorate to consider the Development Plan Document, having now completed and submitted his report, ceases involvement with the future progress of the Plan. Please note that there is no opportunity for members of the public to make any comments or representations on the report, the Examination process now being complete. The Programme Officer also ceases her involvement with the Waste Management DPD. Any correspondence with regard to the Plan should now be sent directly to the Council.

10 May 2017

Further documents have been added to the Examination Library section 'Documents received from the Council'.

These include the Council's response and actions identified from the representations to the Bradford Waste Management DPD Main Modifications consultation and are contained in document PS-B031 10.5.17 Statement of Consultation.

The Inspector is now considering the issues raised in the representations on the Main Modifications and the Council's responses. No further representations or correspondence should be submitted.

The Council have identified an error in the Sustainability Appraisal of the Proposed Modifications.

The error is as follows:

Table 2.1, Screening the Changes - Bradford Waste Management DPD. The summary of the screening assessment of Site WM3 in response to modifications regarding landscape and visual amenity and ecology has been updated to ensure it is consistent with the assessment as provided in Appendix 1, Site Assessment Matrices. The summary now reads: - Screening conclusion: the assessment of the site in relation to objective SA5 has changed from a major negative to a minor negative effect. Please see Appendix 1.

The Council have now placed a revised version on the webpage below, with an errata sheet in the document. The document is also published on these pages as PS-Bo32, Documents received from the Council section.

Public consultation on Proposed Main Modifications to the Waste Management DPD has started and runs until Wednesday 29 March 2017, representations to be received by 3pm on 29 March 2017. The Council has responded to the Inspector's Views on the Proposed Modifications document and this new document is now published under 'Documents received from the Council' as document number PS-B019.

Further information regarding the future progress of the Examination and publication of the Proposed Modifications and consultation process will be published in the near future. Those parties who have made representation to the Waste Management DPD will receive communication from the Council in due course.

A new document has been added to the Examination library. Please see Section 1, Documents received from the Inspector, document PS-A009. The Inspector has now considered the Council's recent documents and has published his views on the Proposed Modifications needed to the Waste Management DPD. This document also provides a useful update on the current status of the progress of the Examination of the Waste Management DPD.

The Council's responses to the Inspector's Matters, Issues and Questions paper were received by the due date of 16 September and have been included in the Examination Library, documents PS B007-013, in response to all Matters 1-7 within the MIQ document. These are now published within the section Documents Received from the Council. One document was received from a representor and this is published as PS C001.

2 August 2016

The Inspector has now carried out his initial examination of the submitted Waste Management DPD, including consideration of the representations made. He has now published the Schedule of Matters, Issues & Questions for Examination (MIQs) in order to seek further information about the legal compliance and soundness of the Plan.

He has invited the Council to submit responses to the MIQs, in statements no longer than 3000 words/Matter. Other representors may submit further statements, if necessary, responding to specific matters and issues relevant to their original representation, with a similar limit of 3000 words/Matter, with no supplementary appendices or additional material.

Any further statements must be submitted to reach the Programme Officer by 4pm on Friday 16 September 2016. Four hard copies and an electronic copy of all statements must be provided.

Please note that the Examination process does not provide the opportunity to make further submissions or raise new issues and evidence not related to an individual or organisation's original representation to the Waste Management DPD. At this stage, and since no representor has sought an oral hearing, the Inspector is not considering holding any hearing sessions to discuss issues relating to the soundness of the Plan. However, he will review the position when he has received any further responses from the Council and representors to the MIQs.

Since the publication of the submitted Waste Management DPD, the Council has added some additional documents to the Examination library, including a list of proposed modifications, which are available by clicking on the appropriate link on this web page.
