Smoke and Carbon Monoxide (CO) alarms

By law, landlords must make sure that a smoke alarm is installed on each floor where there is living accommodation for their tenants. They must also provide a carbon monoxide (CO) alarm in any room that has a solid fuel burning appliance in it. Landlords must check that the alarms are in working order when a new tenancy starts. These duties were introduced by the Smoke and Carbon Monoxide Alarm (England) Regulations 2015. Landlords of HMOs have additional duties linked to fire precautions.

To be effective smoke alarms must be fixed to the ceiling. It is important that the tenant is asked to test the alarm each week and that the landlord changes the battery once a year. The alarm should be vacuumed and wiped annually to ensure dust is not blocking the sensor. The Council will generally expect the smoke alarms to be linked and although radio linked battery operated smoke detectors are available, a hard wired system is much more reliable and therefore the better option.

Back to back and through-by-light properties pose a much higher risk of harm should a fire occur, as there is only one means of escape and these type of houses will normally require a hard wired fire detection system and may also require an escape window on the first floor. We have prepared some extra guidance on what is needed.

The Council is responsible for making sure that landlords comply with their duties. If the Council believes that a landlord is not complying with their duties it must serve a notice on the landlord and can then require the landlord to pay a penalty charge if they still do not comply. The Council is required to publish a statement of principles that it will apply when deciding on the amount of a penalty charge. These are set out in Appendix 2 of the Council’s Enforcement Policy.
