Local Plan Privacy Notice
This Privacy Notice is here to help you understand how the City of Bradford Metropolitan District Council (CBMDC) Local Plan team processes your personal data. This notice should also be read in conjunction with the council's corporate Privacy Notice and other specific service notices.
Plan-making is governed by planning legislation and must adhere to formal regulations and procedures. Part of the process involves consultation with organisations and members of the public. How we manage information is also governed by other forms of legislation including:
- The Data Protection Act (DPA) which aims to protect individuals from having their personal details made public, and
- The Freedom of Information Action (FOIA) which allows the public to have clear information about how information is managed and to get access to information that they need.
About this notice
This Privacy Notice is only relevant to the Local Plan Team at Bradford Council. A separate privacy notice is available for the planning service covering planning applications and associated services. Bradford Council is registered as a 'Data Controller' as defined by Article 4(7) of the UK General Data Protection Regulation (GDPR). What personal data do we collect?
We hold the following personal information:
- name
- address
- telephone number
- business, organisation; and
- agent details
How have we obtained your personal information?
We have obtained your personal data from you, your organisation, or your appointed agent or representative. This data has been supplied:
- as part of representations made during the formal stages of plan-making (including neighbourhood plans), planning policy document reviews or updates to existing planning publications
- as part of the development of Bradford Council's land database (Strategic Housing and Employment Land Availability Assessment)
- as part of the register of interest in Self-Build and Custom Housebuilding
- through technical evidence to inform plan-making
- as part of the registration process on our OpusConsult consultation website
- as an opt in to the Council's 'Stay Connected' email service and selected local plan or planning policy updates.
In addition, the local plan team has also collated information on consultees as detailed in Bradford Council's Revised Statement of Community Involvement (SCI) 2018-2023.
What is the purpose of collecting my personal data?
Within plan making there are a number of ways in which the Council will collect personal data, these are outlined below.
Plan-making and related
The Council needs to meet the provisions of various planning acts, regulations and guidance including:
- The Localism Act (2011)
- the Planning and Compulsory Purchase Act (2004)
- the National Planning Policy Framework (2018) and associated regulations.
In the preparation of local plans there is a requirement to engage with various consultation bodies and members of the public.
The local planning authority is required under planning regulations to publish a detailed statement on representations received after each consultation stage. Individuals names and organisation names may be published within these reports for reasons of transparency. These reports are required to be submitted to the Secretary of State as part of the plan Examination process.
Land information databases
The information supplied by you or on your behalf in relation to housing or employment sites forms part of our land information database for the purpose of producing the Strategic Housing and Employment Land Availability Assessment.
Should you decide not to provide any of the information we request from you we cannot include the site you have put forward in the database.
Similarly, information supplied by you or on your behalf in relation to the brownfield land forms part of the Brownfield Land Register.
Self-Build and Custom Housing Register
This information is supplied by you or on your behalf to register your interest in self-build and custom house building within the Bradford District. The personal data requested is required under the Self Build and Custom Housing Building Act (2015) for the purpose of creating a register of interest.
Should you decide not to provide any of the information we request from you, your interest in self-build and custom housebuilding will not be placed on the register.
OpusConsult consultation website
This information is supplied by you or on your behalf as part of the submission of representations (comments) during a public consultation exercise on the Local Plan or other planning policy documents.
Stay Connected
The purpose of this service allows the Council to keep local residents and stakeholders informed about the preparation of planning documents.
Who do you share this data with?
Land database and plan-making
Data is not shared outside the local authority except where representations are collected as part of local development plans and neighbourhood plans and processed in accordance with the relevant planning regulations.
Self-Build and Custom Housing Register
The register is used to inform plan making. The personal data is not shared outside of the local authority; however, the Council is required to report to the Government the details of the total numbers of entries held within the register.
OpusConsult consultation website
Data is not shared outside the local authority except where representations are collected as part of local development plans and neighbourhood plans and processed in accordance with the relevant planning regulations.
Stay Connected
The Stay Connected database is used to inform interested parties of upcoming publications and consultations and is not shared outside of routine data sharing within the Local Authority.
How long do we keep this data for?
The contacts on the land database will be retained as long as is necessary to carry out the functions for which is was originally collected and updated as part of a formal review or when land use submissions are made. Representations linked to plan-making will be retained for no more than 7 years. We will not keep this information for longer than is necessary.
We will endeavour to keep your information accurate and up-to-date and will undertake reviews periodically in relation to the land database and representations, particularly during and following consultations when we receive notifications of non-deliveries and requests for amendments, removals or updates.

I want to make a complaint – who do I contact?
